1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and OpenStructure ("we," "us" or "our"), concerning your access to and use of our website as well as any related applications, services, and booking arrangements.

You agree that by accessing our website and/or making a booking, you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are prohibited from using the website and services and must discontinue use immediately.

2. Website Usage Terms

Eligibility

By using our services, you represent and warrant that you are at least 18 years of age and possess the legal authority to enter into a binding agreement with us. If you are using the service on behalf of a company, organization, or another legal entity, you represent and warrant that you have the authority to bind that entity to these Terms and Conditions.

Account Responsibility

When you create an account with us, you must provide accurate, complete, and up-to-date information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our service.

You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Acceptable Use

You agree not to use the website:

  • In any way that violates any applicable national or international law or regulation
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation
  • To impersonate or attempt to impersonate the company, a company employee, another user, or any other person or entity
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the website, or which, as determined by us, may harm or offend the company or users of the website or expose them to liability

The website and its original content, features, and functionality are and will remain the exclusive property of OpenStructure and its licensors. The website is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of OpenStructure.

Content found on or through this service is the property of OpenStructure or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.

3. Booking and Payment Terms

Booking Process

By making a booking with OpenStructure, you agree to provide accurate and complete information for all travelers included in the booking. A booking is confirmed once we have received the required deposit or full payment and issued a confirmation invoice or email.

Pricing and Payment

All prices displayed on our website are quoted in the specified currency and are subject to change without notice until a booking is confirmed. The price of your tour will be confirmed at the time of booking.

Payment terms:

  • A non-refundable deposit of 25% of the total tour cost is required at the time of booking
  • The remaining balance must be paid no later than 60 days before the departure date
  • For bookings made within 60 days of departure, full payment is required at the time of booking
  • Payment can be made by credit card, bank transfer, or other methods specified at the time of booking

Price Changes

While we make every effort to ensure pricing accuracy, we reserve the right to adjust prices in the event of:

  • Currency fluctuations affecting our costs
  • Increases in transportation costs (including fuel)
  • Changes in taxes, fees, or charges imposed by third parties

If the price increase exceeds 10% of your total tour cost, you may cancel your booking and receive a full refund of all monies paid. Any such cancellation must be made within 14 days of being notified of the price increase.

Travel Documentation

You are responsible for ensuring that you possess all necessary travel documentation, including valid passports, visas, vaccinations, and insurance. OpenStructure is not responsible for any consequences resulting from inadequate documentation.

Passports must be valid for at least six months beyond the return date of your trip. Visa and vaccination requirements vary by destination and are subject to change. We recommend consulting relevant government agencies or a travel medicine specialist for the most current information.

4. Tour Participation and Conduct

Physical Requirements

Our tours may involve activities of varying physical difficulty. It is your responsibility to ensure that you are physically capable of participating in the tour activities. You must inform us at the time of booking of any medical conditions, disabilities, or special requirements that may affect your ability to participate in the tour.

Traveler Conduct

You agree to comply with all reasonable instructions issued by our staff, tour leaders, or local representatives during your tour. We reserve the right to refuse service to anyone whose conduct is deemed inappropriate, disruptive, or in violation of these terms.

Unacceptable behavior includes but is not limited to:

  • Actions that disrupt or threaten the safety or enjoyment of other travelers
  • Verbal or physical abuse towards our staff, suppliers, or other travelers
  • Damage to property or facilities
  • Failure to comply with local laws and customs
  • Excessive alcohol consumption affecting the enjoyment of others

We reserve the right to terminate your participation in a tour if your conduct is deemed inappropriate. In such cases, you will be responsible for arranging your return transportation at your own expense, and no refund will be provided for unused services.

Group Tours

For group tours, we reserve the right to:

  • Change the designated tour leader at any time without prior notice
  • Alter the itinerary if necessary due to operational constraints
  • Combine smaller groups to ensure tour viability

5. Changes and Cancellations

Changes by You

If you wish to change any part of your booking after confirmation, you must inform us in writing as soon as possible. While we will make reasonable efforts to accommodate your requested changes, we cannot guarantee that such changes can be made. If changes can be made, an administration fee of £50 per person per change will apply, in addition to any costs or charges imposed by our suppliers.

Cancellations by You

If you need to cancel your booking, you must notify us in writing. Cancellation fees apply as follows:

  • More than 60 days before departure: Loss of deposit
  • 60-31 days before departure: 50% of total tour cost
  • 30-15 days before departure: 75% of total tour cost
  • 14 days or less before departure: 100% of total tour cost

We strongly recommend purchasing comprehensive travel insurance that includes cancellation coverage.

Changes or Cancellations by Us

We reserve the right to make changes to any aspect of your tour if necessary. Most changes will be minor, and we will advise you of them at the earliest opportunity.

In the rare event that we must significantly change or cancel your tour, we will offer you the following options:

  • Accepting the changed arrangements
  • Purchasing an alternative tour from us, of a similar standard if available (with either a refund or additional payment, depending on the price difference)
  • Cancelling your tour and receiving a full refund of all monies paid

A significant change includes a change of departure date or a change of departure city, a significant change of destination, or a price increase of more than 10%.

We reserve the right to cancel a tour in the event of insufficient participation, force majeure, or other circumstances beyond our control. In such cases, we will refund all payments made to us but will have no further liability.

6. Limitation of Liability

OpenStructure acts as an agent for transportation companies, hotels, and other service providers. We are not responsible for any injury, loss, accident, delay, or irregularity that may be caused by defect in any vehicle or the negligence or default of any company or person engaged in carrying out or performing any of the services involved.

Our liability for claims related to your booking is limited to the total price paid for your tour. We are not responsible for:

  • Acts or omissions of third-party suppliers
  • Circumstances beyond our reasonable control (force majeure)
  • Any loss of enjoyment or disappointment you may experience due to circumstances beyond our control
  • Personal injury or death resulting from activities you choose to undertake during your tour
  • Loss or damage to your personal property during the tour

Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury resulting from our negligence, fraud, or any other liability that cannot be excluded by law.

7. Insurance Requirements

It is a condition of booking that you have comprehensive travel insurance coverage. Your insurance must include coverage for cancellation, medical expenses, repatriation, and evacuation. We reserve the right to request proof of insurance at any time, and if you fail to provide such proof, we may terminate your booking with no refund provided.

8. Force Majeure

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms that is caused by events outside our reasonable control ("Force Majeure Event").

Force Majeure Events include but are not limited to natural disasters, war, terrorism, riots, civil unrest, industrial disputes, epidemics, pandemics, government regulations, technical problems with transportation, and adverse weather conditions.

9. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising under these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

10. Changes to Terms and Conditions

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services following any changes indicates your acceptance of the revised Terms and Conditions.

It is your responsibility to review these Terms and Conditions periodically for changes. The date of the most recent revision will appear at the top of this page.
